Isaev A. Donation Contract In Civil Code Of Ukraine

Dissertation is the first complex research of donation contract after the essential update of this contractual institute in Civil code of Ukraine. Dissertation is devoted to the analysis of legal nature of donation contract. The historical sources and place of donation contract in the system of civil legal agreements, are examined. The separate elements of donation contract are investigated. The features of subject composition of donation contract, specific of its conclusion and implementation, are analysed. Certain attention is devoted to the problems of donation contract content as an liability legal relationship. The law consequences of rights violations and non-fulfillment duties in donation contract are analyzed. The dissertation reflects ground and terms of donation contract stopping. An author gives legal description to the donation contract, determining its substantial signs. Critical look on advantages and lacks of the leagal adjusting of donation contract are offerd. Remarks in relation of found out legislative blanks and collisions are accompanied by the proper suggestions on perfection of the working Civil code of Ukraine.
