Voronin Y. Civil protection of inventions in Ukraine

The thesis is devoted to complex research of inventions civil protection in Ukraine. In the research it is determined that prior to getting the results of the invention qualifying expertise for its patentability compliance the human intellectual activity result can not be considered as a invention. It is examined the possibility of the human intellectual activity results division into inventions and the objects that according to their contents are not inventions and therefore can not be considered as the inventions. The issues of personal property and non-property rights realization by realization of own authorities concerning the discoveries are under research, the problem of property-rights circulation and the procedure of their legal protection is under analyses. As the result of the domestic and foreign legislation, court practice and juridical literature analyses in the research work the conclusions are grounded, the propositions concerning improvement of effective legislation in the sphere of civil protection of inventions in Ukraine are laid down.
