Kucher T. Court defense in the process of civil judicature in Ukraine

The thesis deals with theoretical and practical aspects of the right to court defense in the process of civil judicature in Ukraine. The notion of right to court defense has been investigated, as well as the right to take legal recourse, the general procedure to realize this right, the right to use it in different kinds of implementation of civil judicature and stages of civil process, concerning some cases. The right to court defense has been analyzed from the point of view of its absolutization, unlimitedness. Its legal nature as social phenomenon existing objectively in public environment irrespective of a will of a person has been revealed. It has always existed itself, as it has been given and guaranteed by the society.
