Trach O. The order of consideration of cases by court of appeal instance in civil procedure of Ukraine

This thesis is devoted to complex research of problems concerning the order of consideration of cases by court of appeal instance. Legal nature, significance, functions, characteristic features of appeal procedure have been researched. The procedural form of consideration of cases by court of appeal instance has been analysed. Conception of a part of court session has been formulated. Procedural action which take place during the court session , namely, in such parts of it as a preparatory part, consideration of the appeal complaint, judicial debate, approval and declaration of court decision have been thoroughly investigated. Legal consequences of consideration of cases by court of appeal have been defined. The problems of law enforcement practice of the order of consideration of civil cases by court of appeal have been revealed. The ways of their solving have been proposed, recommendations directed towards the improvement of civil procedure legislation of Ukraine have been formulated.
