Nemesh P. Legal Protection of Trade Marks in Ukraine

The dissertation is devoted to the complex research of the problems of legal protection of trade marks in Ukraine. The issues of generally theoretical and practical meaning as well as comparative-law research of trade marks legal protection in foreign countries are studied in the work. These aspects are discovered by studying the history of trade marks legal protection, the concept and the subject matter of trade marks legal protection, its role and function in state economical development; analysis of arising and ceasing issues of trade marks legal protection, peculiarities of national international provisions of trade marks legal protection; research of foreign countries experience in the problem discussed. The scientific results based on the analysis of legal literature, national and foreign legislation provisions, court practice are proved in the work. Summarizing the conditions and tendencies of developing trade marks legal protection in Ukraine is considered, the propositions for improvement of Ukrainian current legislation are formulated.
