Maevska A. Burden of property retention and consequences of its violation in the Civil Law of Ukraine

Dissertation is devoted to research of problems of origin and existence of burden of property retention in the Civil Law of Ukraine. The establishment evolution of ies is analyzed for a proprietor, concerning his (her) property. Approaches of modern researchers are analyzed in relation to nature of burden of property retention and consequences of its violation. Attention to decision of burden of property retention as complex and mixed subinstitute is spared. It is set the essence and purpose of burden of property retention, the subjects of burden of property retention and the objects' features of legal relationships of burden of property retention subinstitute. Consequences of duty violation of burden of property retention are set. On the basis of conducted research the suggestions are formulated in relation of improvement of current legislation of Ukraine
