Nykytyuk M. Legal Grounds and Procedures of the Ships' Registration in the Territory of Ukraine

The theoretic generalization and a new solving of scientific problem of imperfect administrative law ensuring of the activity for fulfilling same legal actions and procedures of examination and resolving individual-single cases which are connected with the conceding to the merchant ships a right to fly the State flag of Ukraine (the conceding of Ukrainian "nationality") by competent state executive power bodies of Ukraine and with the registration of ships which have conceded the right, are given in the dissertation. It is proved, that the registration of vessels is an independent (special) kind of administrative law procedures. The negative opinion as to the purpose and the content of ships' registration in so called "convenient" and international registers, at a whole, and as to the creation of Ukrainian international ships' register "as a part of State ships' register of Ukraine" (in the way proposed by the CNSD of Ukraine decision), in particular, is expressed.
