Essay

The process of formation and stabilization of Legal regulation of building and organizing maintenance of the railway net in Ukraine is thoroughly investigated in the thesis. Economical and social conditions in Ukraine during late XIX and early XX cc are analyzed. The conclusion is made, that these very conditions made it possible to build railway lines and their branches. The main stages of the process of railway building and maintenance and its legal ground are considered respectively. They are as follows: the period of state building of railways (1855-1865); the period of concessional building (1866-1880); the period of government building and maintenance (1880-1890); the return to concessional way of building and maintenance (early XX c). The fact that the foundation and maintenance of the railway net throughout Ukraine was strictly controlled by the state power which adopted legal documents and acts regulating all possible items of functioning the railways is proved in the thesis. It is highlighted that the main function of the Ukrainian railways of the late XIX, early XX cc was to create optimal conditions for their uninterrupted maintenance. Great attention is paid to the problems of legal regulation of creating railway joint-stock companies, disposal of property and land for building of railways and their branches, financing construction and maintenance railways, introducing and exercising fares.
