Essay

The dissertation presents complex investigation of both theoretical and practical issues in legal regulation of guarantee payments in labour legislation of Ukraine. The stages of labour legislation development in terms of guarantee payments assignment have been determined and the peculiarities of each stage have been analysed. The analysis of legal regulation of guarantee payments in international legal acts and in foreign legislation has been carried out. The specific characteristics, socio-economic and legal significance of guarantee payments in the theory of labour law have been studied, the notion of guarantee payments has been elaborated. The types of guarentee payments have been classified. The correlation between guarantee payments and other payments effected by employers in behalf of employees has been analysed. It has been proved that the institute of guarantee payments is formed in labour law. Certain types of guarantee payments, their legal treatment have been investigated. It has been proved that dismissal pay, commutation of annual leave or its part, payment for enforced idleness in a case of illegal dismissal or transfer to another post, as well as installation grants in the form of a salary and lump-sum allowance are the guarantee payments by their purpose and scope.
