Diptan S. Ecological and economic principles of the improvement of the checking system as for using and preserving the lands of non-farming purpose

In the dissertation the scientific approach is expounded with the aim to improve the checking system as for using and preserving the lands of non- farming purpose. The concept of economic mechanism of control is formulated to use and preserve the lands as the system of measures, forms and methods directed on perfection system of management control of agrarian resources by influence financial and economic levers on the subjects of agrarian relationships with the view to counteracting and prejudicing the inefficient use and disposing agrarian resources with the violation of existent norms and requirements of legislation. It is grounded the method of estimation of ecological harm (to the loss),caused to our environment, natural resources, health of population and also different subjects of legal relationships and economic activity, in particular the economic formula is offered to count losses and damage, predefined by damage and elimination of all types of property and resources including natural resources and plots of(lots) lands of non- farming purpose, a greater part of which refers o the objects of a real estate. The necessity of introduction of institute of administrative responsibility of legal entities, which utilized the widest rank in legal practice of European Union and becomes actively claimed and justified in Ukraine is well-proved. The method of determining the size of harm, predefined by contamination and obstruction of lands through violation of nature protection legislation is improved, it is namely suggested to replace the index of normative money estimation agrarian plots which tested contamination on the resulted norm of charges on the compensation of cost of the lost or damaged natural properties of agrarian lands on an administrative district.
