Brovchenko I. Participation of third parties in civil obligations

The thesis contains the complex research into problems of participating of the third person in civil law obligations. The idea of a person being the central category of jurisprudence instrument is analyzed in this work, the essential features of the third person in obligations are first formulated, teaching about different kinds of the third person is developed. Problems of participating of the third person in thing, corporative and inheritance relations are researched here as well as relations in intellectual property. Specific qualities of the third person are analyzed in connection with their participating in separate groups of obligations. Thus questions of fulfillment of obligations by the third person are researched, particular qualities of obligations in favor of the third person, as well as grounds and forms of participating of the third person in guaranteeing of the fulfillment of obligations. The work contains thorough analysis of questions, connected with protection of the rights of the third person in obligations. Generalities about the third person’s rights protection and also specific methods, problems of choosing and fulfilling the way of defense are analyzed in this work.
