Bernaz-Lukavetska O. Housing exchange (residential premises): civil aspects.

The thesis is devoted to the research and substantiation of the civil aspects of the housing exchange. The issue of national legislation development on the housing exchange (residential premises) has been analyzed, the definition of the right to housing exchange has been made and its legal nature has been established. In general the essence of the right to housing and the right to housing exchange have been examined in detail. The subject of the housing exchange (residential premises), general conditions of the accommodation exchange (residential premises), the issue of the forced exchange have been analyzed in detail. Special attention has been paid to the particular cases of the housing exchange (residential premises), namely to the features of the residential premises exchange according to the rent of the social living space, the residential premises exchange in the houses (flats), which belong to citizens (the right of private property), and also the residential premises exchange in the building and loan associations. The proposals for a number of provisions in the current legislation in the regulation of housing exchange and conflicts elimination between the Civil Code and the Housing Code of Ukraine have been formulated."
