Timoshenko I. Legal liability for violation of electoral legislation of the Ukraine

This Dissertation is devoted to theoretical and practical problems of realization of mechanism of legal liability for violation of electoral legislation of the Ukraine. In this work the legal nature of violation of electoral legislation is investigated as a basis of legal liability and as an specifically type of violation; its definitive characteristic in essence and on its face was also made. Distinctions of elements of legal composition of electoral violation (object, subject, objective aspect, subjective aspect) were analyzed; and proposals considering optimization of its legal regulation were submitted. Classification of violation of electoral legislation of the Ukraine was made according to different criteria. Distinctions of realization of constitutionally-legal, criminal, administrative, civil and disciplinary liabilities for violation of electoral legislation of the Ukraine were described in details. A set of assumptions was substantiated considering necessity of alteration and insertion of addenda into electoral legislation in power and into legislation on legal liability.
