The thesis is devoted to the issues of the judiciary formation in Ukraine. The formation and the development of legislation on the appointment of judges are analyzed. The author proposes the amendments to and the improvement of the judiciary formation procedure in Ukraine by means of the legislative establishment of the existing rules. Taking into account the conception of the constitutional and legal aspects of the professional judiciary formation in Ukraine, the author proposes: the legislative establishment of the status «judicial candidate enrolment» and «judicial candidate»; the introduction of the psychophysical testing for the judicial candidates
