Soboviy O. The legal status of judges in administrative and delictual proceedings

The thesis is a comprehensive monographic study devoted to theoretical and practical aspects of implementation of legal status of judges in administrative and delictual proceedings. Concept, features and functions of the judiciary are analyzed, its correlation with the administrative process is determined. The structure of the administrative process and place of administrative and delictual proceedings in it are disclosed. Concepts, features and principles of judge's activity in the proceedings in cases of administrative offences are defined. The content of the terms "legal status", "administrative and legal status", "competence" are analyzed. The procedure of implementation of status of the judge at corresponding stages of administrative and delictual proceedings and possibility to learn from the experience of the legal regulation of judges' activity in foreign countries are investigated. Proposals for improving the legal status of judges in administrative and delictual proceedings were formulated.
