Petrenko S. Legal Protection of Computer Software as an Object of Intellectual Property: Ways of Development

This thesis is devoted to the integrated study of the legal nature of computer software protection as an integrated object of intellectual property on the modern level of information technologies development. Conceptual framework used for computer software determination has been analyzed. Main signs of computer software have been described. By correlation of computer software with literary work as a classical object of copyright both elements of content thereof and forms of expression have been determined, as well as recommendations for determination of computer software originality have been worked out. The possibility of use of the mode of legal protection of other intellectual property objects (namely: invention (utility model), innovation proposal and industrial design) for computer software and components thereof is being studied. The necessity of formation of a separate computer software legal protection mechanism as a specific intellectual property object within the copyright law has been grounded
