The dissertation is dedicated to complex research the material rights to cult property of religious organizations and solving the problem of true transfer of cult property to religious organizations by the state. The author conducts differentiating of religious organizations and other religious formation. Religious organizations is considered as a subject of civil legal mutual relations and a property owner. The cult property is considered as separate object of the material rights. The author gives definition of the cult complex as a cult property. Considerable attention is paid to characterization of separate material rights to cult property of religious organizations. The author investigates the existing ways and forms of protection of property rights and means of acquisition of right of ownership and material rights to strange cult property of religious organizations. On the basis of experience of postsocialist countries, by an author the mechanism of returning and gratuitous transfering of cult property to religious organizations is offered, decision of property wrangles between them, and defence of their property rights as the project of the special law
