Shumliaieva I. Formation and development of the territorial community institute in Ukraine: organizational and legal aspect

The object of the investigation is social relations that are taken place in the process of formation and development of a territorial community in Ukraine. The goal of the paper is scientific-theoretical grounds of organizational-legal principles of a territorial community formation and development as a subject of authoritative powers. The methods of the investigation are: a complex of general scientific and special research methods - system, historical, comparative, formal-juridical, statistical analysis, classification and synthesis methods. The scientific novelty is a complex of theoretical and scientific-practical statements relating to organizational-legal ensuring of a territorial community development, in the first place, object-functioning component of powers execution by a territorial community, realization of the mechanism of representative and direct democracy, population self-organization bodies activity, interaction of a local community and local government bodies, statutory norms creation are offered in the paper for the first time; periodization of formation and development of the territorial community institute in Ukraine; approaches for organizational-legal regulation of formation, joining and stopping of territorial communities functioning; directions of intensification of population self-organization bodies activity; ways of improvement of organizational-legal ensuring of the process of the territorial community statute adoption are improved.
