Masyuk V. Presumption and prejudices at the civil court proceedings

The dissertation is devoted to the investigation of the problems concerning legal regulation and practice of the presumptions and prejudices use at the civil court procedure of Ukraine. The main approaches as to the interpretation of the presumptions and prejudices conceptions have been analyzed and generalized and their meaning in connection with the evidential activity has been revealed. The bounds of presumptions and prejudices during the civil proceedings trial have been determined and the delimitation with the adjacent conceptions has been accomplished. The special attention is given to the fact that presumptions and prejudices are the impartial way with the help of which the bounds of the court discretion realization have been determined. The number of the conceptual theoretical conclusions and practical recommendations as to the improvement of the legislation in force in the field of the presumptions and prejudices use have been formulated.
