Essay

The dissertation provides an academic model of an individual's right to personal data. The author focuses on the object, substance, legal nature and content of the right. The author maintains that the notion of personal data includes any information concerning an identified or identifiable natural person. She further explores qualities, peculiarities and access regime of personal data, historical evolution of the concept of personal data as an object of an individual right. The author emphasizes that the right to personal data is a personality right, which ensures an individual's capacity to control processing of information pertaining to her person and analyses its correlation with other personality rights. The author proposes to define content of the right to personal data as that of data possession (includes rights of access and notification); data use (includes rights to consent to and object against the processing and to data security), and the right to defence. As a result, the author comes up with a number of legislative proposal
