Matviyenko P. Administrative Responsibility for Violation of Commercial Confidentiality Legislation

The dissertation considers theoretical and administrative-legal issues of administrative responsibility for breaking legislation on commercial confidentiality. The issues of administrative legal protection of commercial confidentiality have been considered comprehensively, legal experience of commercial confidentiality protection in Ukrainian legislation has been analyzed. The social stipulation of illegal actions constituting commercial confidentiality has been disclosed. The great emphasis has been made on the issue of the subject of the analyzed offence. The author has investigated objective and subjective attributes of illegal collection, usage and disclosure of commercial confidentiality to disrupt business reputation and the property of another entrepreneur, has determined the period of termination of each type of the given offence. The realization of illegal collection, usage and disclosure of commercial confidentiality to disrupt business reputation and the property of another entrepreneur has been separated from the related delicts. The suggestions for the improvement of the normative constituent of commercial confidentiality protection in Ukraine have been made.
