Kirilyuk A. The License contract on the use of literary works (civil law aspect).

Dissertation researches into and grounds theoretical issues of the use of literary works through license agreements (contracts). The present state of civil scientific and practical sources dealing with the matters of license contract application is analyzed. The notion and specific character of legal relationships, which arise in connection with the use of literary works and/or their elements as well as the nature of the subjects of the above-mentioned legal relationships, are specified in the dissertation. The definitions are suggested for a literary work, literary character, license contract for the use of literary work. The following aspects were examined: the development of obligation relations concerning the use of literary works, entering a contract, alteration and termination of its effect. Essential conditions of a contract, rights and obligations of the parties thereof, responsibility for the breach of the license contract and the grounds for the dissolution thereof were defined in the process of research. On the basis of the conducted research, suggestions for the improvement of current copyright legislation were moved.
