Tylyk T. Cessation of the housing legal relations

Thesis for obtaining a scientific degree of Candidate of Science (Law) with a specialization in 12.00.03 - civil law, civil procedure, family law, international private law. - Kyiv National University of Internal Affairs. - Kyiv, 2010. The thesis researches the legal essence of subjective housing rights of citizens, their constitutional background, components of legal relations in housing law, their grounds and legal consequences of termination. On the basis of the analysis of legal norms, scientific sources and court practices theoretical and practical conclusions on controversial issues are formulated, recommendations on improvement in housing and civil legislation are made in order to improve the application of the housing rights of citizens. A definition of termination of legal relations in housing law is formulated, notions of eviction and resettlement are distinguished, additional protection mechanisms of the housing rights of minors and legally incapacitated persons are proposed. The proposal of establishment of a special housing fund for persons being evicted and having nowhere to go is found to be sound.
