Pantaliyenko Y. The procedure of fulfilment of notarial acts.

The dissertation is dedicated to analysis of procedure of realisation of notarial acts from formation of concept to its perception in wide understanding and applications on an example of the certification of the confidential will. In work the proportion of notarial procedure and form is analysed, procedure elements, and also the general rules of execution of notarial actions are investigated. The special attention is given to problem questions concerning theoretical and practical perception of notarial procedure, and also its regulation in legislation. The structure of notarial procedure which consists of three elements is formulated: certain sequence (order) fulfilment of notarial actions, which are developing into notarial procedure; the general rules of fulfilment and rules of fulfilment of separate notarial actions, which regulate powers of the notary concerning fulfilment of notarial action (procedure); rules of fixation of the notarial actions made by the notary. In work changes of the notarial legislation and propositions on improvement of activity of notaries are offered.
