Smilyanets I. Replacement of a debtor in obligation upon civil legislation.

Dissertation is devoted to the problems of replacement of the debtor in civil obligation, that arise in civil circulation, the scientific research is based upon court practice materials. Main historical stages and prerequisites of developing of this institutions in Roman private law and according to national legislation of different periods are analyzed in the work. Main elements of replacement of the debtor such as conception, subject, grounds and consequences are researched in the work. Conception and the main kinds of restrictions of chose in action concession are described in the work. Some problems of them are analyzed, such as impossibility of passing of some debts. In the Thesis the attention is paid to a mechanism of replacement of the debtor. Also grounds, conditions, consequences, limits and restrictions and consequences of the replacement of the debtor are examined in the work.
