Shlicov D. The legal nature of property leasing as a form of national - private partnership

The thesis deals with the complex analysis of scientific thoughts, views and concepts of Ukraine legislation and the legislation of foreign countries, judicial practice, in the sphere of national and public property. New form Ukrainian economic legislation as a judicial category has been analysed in this paper. It is a leasing as a form of national private property. As a result of this analysis we considered a role of partnership to be very low. The partnership must be given a role of legal, judicial mechanism in the alliance of subjects motivation according to the partnership's concepts and state's initiatives, costs, risks for the sake of their objectives, interests and demands. But at the same time they must have a tendency to achieve their common goal, they must support the provisition of economic social directions due to the property uniting. On the one hand it must be investings of different resources, on the other hand it must be proprietorship's initiatives. New scientific solutions have been worked out. New proposals have been given to accelerate the development of legislation formation in the sphere of national and private leasing, which must be a base of economic subjective and efficient mechanism to regulate the national private property relations and to contribute to its formation.
