Sokol M. Procedure of collective labor disputes and conflicts solving in Ukraine.

Dissertation is devoted to a comprehensive study of legal regulation current theoretical and practical problems of collective labour disputes and conflicts solving. In this paper work the boundary delimination of legal categories "collective labour disagreement", "collective labour dispute" and "collective labour conflict" is made; their common and distinguishing features, legal nature, kinds, origin causes and possible ways of preventing of collective labor disputes and conflicts rising are considered. The current legislation of Ukraine is analysed, its comparative-legal analysis with labour legislation norms of the CIS and the EU is carried out. The phased advanced legal analysis of the collective labour disputes solving procedure with the help of conciliation bodies is presented, a number of proposals to improve the procedure for their consideration are grounded. Much attention has been given to the law regulation study of the collective labour disputes solving through strikes in the national legal system and legal systems of foreign countries. Based on the conducted research, the specific proposals for current legislation improvement, that regulates the collective labour disputes, conflicts solving procedure, are formulated. Conclusions and proposals, that are presented in the dissertation, let to improve this area of labour law, to harmonize it with international labour law norms.
