Nemchenko S. Electrical energy supply contract under the civil legislation of Ukraine

The main subject of dissertation is research of the electrical energy supply contract through the joined network under the civil legislation of Ukraine. The paper defined the concept and features of the electrical energy supply contract. Subject of the research is the legal nature and place of specified contract in the system of energy supply contracts and civil contracts in Ukraine. The dissertation is researching and determining the concept, the legal nature and place of the electrical energy supply contract of through the connected network. It is formulated position on the classification of electrical supply contracts through the joined networks into three groups depending on the typology of accessories (on features of the subject of contract): 1) contracts on the transfer of property, 2) contracts on the provision of services, 3) contract of adhesion to the trading system. In the dissertation it is specified special features of the elements of the electrical energy supply contract, especially inherent to this contract specific way of fulfilment of the obligation, which lie in necessity of energy transfer to the subscriber via joined network. Unlike the supply contract, electrical energy is transferred to consumers through the connected to organizations supply network, thereby it is ensuring uninterrupted supply of energy. Substantiated the conclusion that energy suppliers must adhere quality rates of electrical energy in situations when consumers are not paying for electrical energy
