Podolyak S. Legal Bases and Consequences of Nullity and Loss of Economic Contracts in Ukraine

The thesis covers issues related to the complex research of theoretical and practical questions of legal regulation of nullity of economic contract and loss of economic contract, their legal bases and consequences in the context of system approach to the economic contract and its legal constructions. The legal nature of economic contract as manner of organization of economic-contractual relationship is examined. The economic contract is considered as social-legal economic system, which consists of components (system elements), united by functional-legal connections (norms of law realization). The law nature of force of the economic contract is defined and scientifically grounded: the notion and standards of force of the economic contracts are considered; the reasonability of legislative assignment of conditions of force of the economic contracts as a special legal category in the Economic Code of Ukraine was substantiated. The legal nature of nullity and loss of economic contracts was examined, their differentiation was proposed.
