Nigreieva O. Legal regulations of ship mortgage.

The dissertation is the first complex research on legal regulations of ship mortgage in Ukraine. In this work a concept of ship mortgage is being determined, main traits of both mortgage and ship mortgage are explored and the bases of creation of ship mortgage relations are analyzed. This work also deals with a civil law characteristic of a ship sea contract as the main basis of mortgage appearing. Here peculiarities of conclusion, fulfilment and termination of a sea mortgage contract are expounded. The author conducted a research of the international and foreign experience of sea mortgage legal regulations. The theoretical conclusions and scientifically sound recommendations regarding the perfection of Ukrainian civil and maritime law and contract regulation mechanism of securing relations using a ship mortgage are laid out.
