Yatsenko D. The right of use the land for the building purpose

This thesis researches the problems of right of use the land for the building purpose, grounded on analysis of scientific literature, national legislation, draft statutory act of Ukraine and other countries, practical activity of enforcement bodies. Specific flags are characterized, and proposed the definition to superficies. Grounding necessity to apply and develop superficies in Civil law of Ukraine further the building activity. Characteristics of superficies are analyzed and proposal submitted to applying it in Civil code of Ukraine. Protection of superficies is determined as the most essential element. Therefore it's necessary to provide into Ukrainian legislation the special instrument of protection superficies. Made a propose to provide into Ukrainian legislation some developed norms and accord it with norms regulating land and building relations.
