Onyshchenko G. Fiduciary Legal Relationships with Foreign Element

The dissertation is dedicated to researching peculiarities of fiduciary legal relationships with foreign element and specificity of their regulation in different countries. The concept and characteristic features of fiduciary legal relationships with foreign element are formulated. The place of such relationships among other civil relationships and relationships which are the object of private international law is investigated. Main sources of law regulating fiduciary legal relationships with foreign element in continental and common law countries are analyzed. Ways of legal qualification of fiduciary legal relationships with foreign element are proposed. The dissertation also covers the problem of determining the sense of foreign law as well as of its application by courts to the regulation of such relations.
