Pristinsky I. Administrative-legal status of religious organizations in Ukraine

Dissertation is devoted to research of administrative-legal status of religious organizations in Ukraine. Methodological principles of place and role of religious organizations are considered among administrative legal subjects, a concept "religious organization" is analyzed in Ukrainian and foreign scientific literature and legislation, basic signs of religious organizations, in obedience to which organizations are considered religious are defined, classification of religious organizations is offered on different criteria. An author defined the concept of "administrative-legal status of religious organizations" and his elements are selected. The analysis of existent rights and duties of religious organizations is carried out. Legal description of grounds and order of creation and stopping of religious organizations is given in research. The stages of procedure of creation of religious organizations are defined. It is analyzed administrative judicial order of stopping of religious organizations in a judicial order. An author examines a structure and plenary powers of organs of management of religious society. A role and competence of subjects authorized is set to carry out state control and supervision after creation, activity and stopping of religious organizations. In addition, an author offers the concrete ways of ensuring of the legal regulation of administrative-legal status of religious organizations and propers changes to the current legislation of Ukraine about the right of conscience and religious organizations.
