Mentukh N. The legal status of leasing activity subjects of Ukraine

The thesis represents an independent complete study providing a complex analysis of the legal status of leasing activity subjects. The terms "subject of leasing activity" and "participant of leasing activity" are determined. The classification of leasing activity participants is worked out and their economic competence is researched. It is grounded that the term "subject of leasing activity" has to be attributed to lessor only; the others are just the participants in leasing activity. The notion and main features of leasing companies are determined and their classification is worked out. The new definitions of a leasing company and a state leasing company are offered by the author. The procedure of foundation of a leasing company and their statutory capital formation are researched systematically. The basic theoretical and practical provisions as for the management of a leasing company are treated. The commercial contracts that are concluded in the course of leasing activity are reviewed. The safeguarding methods of the contractual obligation completion are determined. The specifics of commercial law liability of leasing activity subjects are researched
