Dуagilev O. Legal institute of lobbying: constitutional and legal aspect.

This work represents a comprehensive study of constitutional principles of such sociopolitical factor as lobbyism, and deals with specifics of constitutional and legal regulation of lobby relations within the context of development of a civil society. The work offers definition of category and meaning of mechanism of lobbyism, proposes systemic classification of its types, and reviews organizational and legal forms and methods of lobbyism and positive and negative features of lobbyism as phenomenon. Foreign constitutional and legal experience in regulation of lobbyism and genesis of Ukrainian lobbying are analyzed. The author arrives at conclusion that lobbyism represents a separate inter-sectoral legal institute, and studies how it's related to constitutional, administrative, and other fields of law. Provisions of Ukrainian law concerning interaction between government and the public were analyzed, and the need in adopting a systemically coordinated law on lobbyism was substantiated. Scientifically substantiated practical recommendations concerning legislative regulation of lobbyism in Ukraine were developed.
