Volkov S. New approaches to the definition and protection of intellectual property.

The dissertation is devoted to theoretical substantiation of definitions and content of legal relations in the field of intellectual property.It explores the following concepts: intelligence,intellectual work, intellectual potential, intellectual product and other. Special author’s attention is given to specification of legal relations, determination of their subjects and the nature of relations in the sphere of copyright and intellectual property. The conclusions are aimed at improving the regulation of legal relations, namely: the definitions are revised; the attention is given to characteristic features of copyright in various spheres of relations. The significant changes to legislation aimed at protecting not only the rights of authors and other owners of intellectual property but also the public interests are proposed. The author suggested to clarify the traditional ways of copyright protection and to intensify the protection of intellectual potential of the state, i.e. of creative professionals.
