Trofunenko N. Economic-legal ensuring of the quality of construction-works

Research object: public relations, arising up in the process of realization of a build activity. Research purpose: development of theoretical and practical questions of the economic and legal providing of quality of build works, grounds of new scientific positions and suggestions on perfection of legislation in this sphere. Research methods: dialectical, abstracting, system-functional, comparatively-legal, legalistically-logical, logical-legal. Theoretical and practical value: separate suggestions are developed on making alteration in the Economic code of Ukraine, Civil code of Ukraine, other legislative acts on providing of quality of build works. Drawn on results in practical activity of "MIRAGE LTD", of "ARCHITECT LTD", Economic court of the Donetsk area, in-process Committee on questions of building, town-planning, housing and communal economy and regional policy of Verkhovna Rada of Ukraine, in-process Inspection of a state architectonically-build control in the Donetsk area of Ministry of regional development and building of Ukraine, at preparation of suggestions to the project of Town-planning Code of Ukraine, in the educational process of the Donetsk national university. Scientific novelty: From existing economic and legal facilities has been allocated economic and legal facilities of the quality of construction-works such as licensing, standartization, the turnkey contract, an establishment of warranty periods, the economic-legal responsibility. The author has specified a concept of the quality of construction-works and set its correlation with the concept of safety of construction-works. It has been analysed normative-legal acts which determine requirements to quality of construction-works. The offers concerning an order of licensing of building activity has been made. The role of building norms in ensuring of the quality of construction-works has been defined. The mode of expression of a condition about quality of works in the turnkey contract has been offered. The necessity of improvement of norm about duration of warranty periods of the quality of construction-works has been proved. The author has offered the ways of improvement of economic-legal responsibility for poor-quality performance of construction-works.
