The thesis is devoted to the actual problems of the legal status of intellectual property rights representative as the subject of the civil law relations. The features of representation in the sphere of the intellectual property law are defined, the participators as the members of such relations are analyzed, distinction of the categories "representative of the intellectual property rights", " patent attorney", "patent agent" are established. The huge attention in dissertational research is given to questions of definition of law status of the patent agent - their rights, duties, professional policy, particular responsibility. The legal status of the patent attorney in foreign countries is separately studied. The functions of the patent agent in relation to different objects of patent law - trade marks, industrial model, invention are investigated. Some ways directed on improvement of the legislation is stated in the thesis.
