Chyzh U. Administrative Liability for Job Performance Offences in Land Relationships Sphere

The dissertation is devoted to the complex research of the institution of administrative liability for job performance offences in land relationships sphere. The essence and the subject matter of legal regulation in land relationships and their historical development are revealed. The distinction between the concepts "service agent" and "authorized agent" as well as the definition of the last one as a special subject of administrative liability in the sphere of land resources are studied. The necessity for implementation of strict mechanism of carrying out powers by officials in land resources sphere aimed at inhibiting from favourable conditions for taking bribes, power or authority abuse are defined. The role and importance of control by administrative justice as well as establishing personal liability of an official of a state enterprise, institution or organization for failing in taking decision are pointed out. The analysis of foreign experience in land relationships legal regulation is prepared; the factors influenced the complexity of the given situation in Ukraine are determined. Several ways of improvement of current legislation concerning administrative liability for job performance offences in question are proved and proposed.
