Zubkov S. Civil legal regulation of the acquisition of ownership of the newly established real estate

This thesis is a comprehensive analysis of legal regulation of ownership to the newly created real estate. Allocated basic features of the newly established real estate, which can only be created during construction. Classification of real estate was made, which include buildings and structures, their parts (apartments, rooms, apartments, uninhabited sections). The basic principles of civil turnover of real estate assets was determined. Grounds for acquisition of property rights of real estate property constructed arbitrarily was designed. The analysis of the partnership contracts, investment cantracts and contract for equity participation in the construction, which are grounds for assuming ownership of the newly established real estate, was made. Made proposal for the development and adoption of the Law of Ukraine "About equity in construction". The main problems of the Law of Ukraine "About complex overhaul quarters (neighborhoods) of obsolete housing" was reaserched and conclusions concerning the necessity of a referendum for the reconstruction of old housing stock and making the investor and owner of real estate contract mines was made
