Research object: relations which arise up in relation to a fictitious management. Research purpose: ground of new theoretical positions on хозяйственно-правовым facilities of warning of fictitious management and development of practical suggestions on the increase of efficiency of their application for the sake of removal of fictitious subjects of management from the sphere of economic activity and minimization of their negative influence on the economy of the state. Research methods: dogmatic, comparatively-legal, system, legalistically-logical, statistical, expert questioning, analysis of documents. Theoretical and practical value: theoretical positions are created by pre-conditions for development of scientific knowledges on the increase of efficiency of adjusting of economic legal relationships which arise up concerning the removal of fictitious subjects of management from the sphere of economy. Dissertation job performances can be the use in a legislation, legal application, research work and educational process. Utillized in practical activity of the Economic court of the Kharkov area; in legislative activity of Committee on questions of legal policy of Verkhovna Rada of Ukraine and Committee on questions of economic policy of Verkhovna Rada of Ukraine; in the educational process of the Vostochnoukrainskogo national university of V. Dalya. Scientific novelty: thesis contains complex analysis of theoretical and practical problems of warning of fictitious manage.
