Essay

The Thesis is devoted to a versatile research of key theoretic principles related to duties and obligations under employment contracts, ways and means of ensuring of employment contract duties and obligations, and legal provisions regulating and governing the same. The Thesis includes determination of the nature and characteristics of duties and obligations under employment contracts. The analysis of the essence and types of ways and means of ensuring of duties and obligations under employment contracts has been carried out. The Thesis defines the following basic concepts related to ensuring of duties and obligations under employment contracts: duties and obligations under employment contracts, and ways and means of ensuring of duties and obligations under employment contracts. The system of such ways and means based on the functional approach has been analysed, including: persuading ways and means, stimulating ways and means (incentives), warning and operative influence ways and means, and involuntary / forcing ways and means. The Thesis also includes a general description of such separate ways and means and peculiarities of applying thereof. Recommendations on legal ways and provisions regulating and governing means of ensuring of duties and obligations under employment contracts have been suggested. The Thesis also contains offers and suggestions regarding improvements in currently effective applicable laws governing ways and means of ensuring of duties and obligations under employment contracts.
