Essay

The dissertation is devoted to complex analysis of historical and legal foundations, the modern state and legal responsibility for the violations of the protection and use of game animals and aquatic resources. The characteristics of the infringements' objective side, specified in the article 85 (part 1-4) of the Administrative Code of Ukraine are analyzed. Public relations, acting as direct object of given breaches are defined. The concretization of these social relations taking into account such spheres of activity as hunting and fishing is conducted. On the basis of present legislation the classification of hunting and fishing violations is provided and the descriptions of their characteristics are given. The meaning of the classifying characteristics of the delicts is revealed.The detailed research of subjective features of infringements which are examined in the thesis is conducted. The attention to the general characteristics relating to the subjects are paid. The classification of the delicts is carried out taking into account their peculiarities. Describing the guilt as a main feature of the subjective side the possibility of committing such violations within the intended guilt (direct and indirect intention), within the careless guilt (self-confidence, negligence) is determined. The attention on such optional features of the subjective side as the animus and the intention is also focused. A number of concrete changes and amendments to the present legislation of Ukraine which will allow to improve the efficiency of fight against violations in the field of hunting and fishing is offered.
