Yaroshenko S. Administrative Responsibility for Violation of Intellectual Property Rights

The dissertation considers theoretical and administrative-legal issues of realization of administrative responsibility for breaking legislation on intellectual property rights of the objects. The notions of administrative and legal protection of the right to intellectual property; administrative and legal protection of the right to intellectual property; the mechanism of administrative and legal regulation of the intellectual property; administrative and delictual proceeding in the sphere of intellectual property; the principle of administrative and delictual proceeding in the sphere of intellectual property; the stage of proceeding in cases on administrative offences in the sphere of intellectual property have been determined from administrative-legal science standpoint. The characteristics of administrative offences which infringe upon the objects of intellectual property has been given, the peculiarities of the elements of the body of the given offence have been determined in particular. The suggestions for the improvement of administrative legislation and practice of its usage have been made to improve the Code of Ukraine on Administrative Violations.
