The dissertation is devoted to the comprehensive research of the problems of criminal and legal characteristic of the premeditated murder by exceeding the limits of necessary defense or in case of exceeding the measures which are necessary to apprehend the offender under the Criminal Code of Ukraine 2001 and the ways to improve the normative regulation of the liability limits for causing death under such circumstances have been suggested. The special features of the responsibility for the premeditated murder by exceeding the limits of necessary defense and in case of exceeding the measures which are necessary to apprehend the offender as for the separate offences have been defined.
