Drobotova T. State-and-legal regime in Ukraine: the contents, attributes and basic tendencies of development.

The dissertation investigates the contents, attributes and basic tendencies of development of a state-and-legal regime of the modern Ukraine. The author analyzes theoretical and methodological bases of research of state-and-legal regimes, offers her own definition of a state-and-legal regime concept, and also investigates the types of state-and-legal regimes from the point of view of a science of the theory of state and law. The characteristic of the basic criteria of allocation of various types of state-and-legal regimes is given. The author is using the dynamic model of their transformation, which is based on such parameters as: a level of development of a civil society and obtaining of the rule of law principle. The special attention is given to the research of essence and legal attributes of a democratic state-and-legal regime. A role of principles of the state of law and social state in the development of a democratic state-and-legal regime is also proved. The characteristic of practical and theoretical aspects of development of system of guarantees of a democratic state-and-legal regime of independent Ukraine is given. The author investigates the specificity of development of a state-and-legal regime in Ukraine from positions of constitutionalism, realization of the constitutional reform, and maintenance of the human rights and freedoms.
