Fayer O. Professional Liability Insurance: Civil Law Aspect.

The dissertation contains a complex scientific analysis of modern theoretical and practical law problems of professional liability insurance. In particular, the term of professional activity is researched and the features of a person that carries out professional activity are selected in the work. The term of professional liability is determined as well as the conditions of its acceptance and its kinds. The criteria of delimitation of professional liability and the liability of the subject of entrepreneurial activity are shown. The comparative analysis of kinds of insurance in general and liability insurance in particular is carried out. The insurance contract of professional liability is investigated. The problem of subrogation and regress usage in professional liability insurance is shaped. The peculiarities of medical workers, auditors and notaries public professional liability insurance are analyzed. It is proved that the professional liability insurance of mentioned subjects has to be carried out mandatory. The analysis of modern law practice of professional liability insurance of medical workers, auditors and notaries is heavily emphasized. The suggestions about the improvement of Ukrainian current professional liability insurance legislation are formulated.
