The dissertation contains a scientifically based concept of the competitive nature of the legal relationship of insolvency and bankruptcy, defining the place of institutions of insolvency law in the legal system and legislation, subject and method of regulation of insolvency and bankruptcy as individual (general) law institute, defined the concepts and the nature, composition (subjects, objects, and content), the base appearance. The main problems of simplified bankruptcy procedures considered. Proposals for improvement of the law of bankruptcy absent debtor are formulated.
