Dissertation is devoted to research of actual theoretical and practical problems of legal regulation of transfers and movement of workers. In the dissertation is investigated a local legislation of transfer procedures and transfer of employees, the legislation of foreign countries, including the Russian Federation, the position of scientists from different branches of law on these issues is found out, a comprehensive analysis of theoretical developments and practical results is made. The necessity of moving beyond the imposition of such a category as a novation of the employment contract is examined. Author's definitions of the categories of "transfer of employees" and "movement of worker" are given, is reproduced the list of sectorals principles, which are common to transfer and movement of employees. The necessity of applying is researched for legal regulation of transfers and movement of workers of two opposing methods of regulation: permission and obligation.
