Geynts R. Civil legal regulation of relations by agreement about providing communal services

The thesis deals with complex research of legal regulation of relations in providing communal services. Effective regulatory and legal framework in the sphere of communal services is analyzed in details, theoretical aspects of agreement regulation of relations in providing communal services are examined. Imperfection of legislative classification of housing services according to their functional purpose is grounded, non-coordination of the legal definition of the concept of "communal services" as a legal category is proved. The author's definition of the concept of the communal service is formulated, the signs of communal services are distinguished. The classification of communal services is made. The definition of the concept of the agreement about providing communal services is formulated, its legal nature, subject and content are studied. Subject structure of the agreement about providing communal services is analyzed. Much attention is paid to the matters of making an agreement about providing communal services, its form is determined, reasons for changes and dissolution of agreement about providing communal services are analyzed. Theoretical conclusions and suggestions for improvement of legal regulation of agreement relations in providing communal services in Ukraine are formulated according to the results of the research, and also the draft Law of Ukraine "On communal services" is elaborated
